Lawyers
Marbella Unique Properties recommends our clients whether buyers or sellers, to always instruct a lawyer from the area who is experienced and knowledgeable in the field for both Local and Spanish law. They help guide the client in the best possible way through the purchase process and do the due diligence on the properties paperwork and ensure the client is purchasing the property correctly, as well as advise on all factors related to the properties situation with regards to the town hall and legal situation. Lawyers also deal with the paperwork to make the client resident in Spain if necessary, and deal with the final changeover of utility bills and annual property taxes from the old owner to the new. We work with a large variety of lawyers on the coast and recommend to choose one that speaks the clients’ native language to help best explain the ins and outs of property law and the purchase.
Banks
We recommend to shop around especially when looking for mortgages, to look at a variety of banks to make sure you get the best possible deal. The majority of popular banks have branches in Puerto Banus and the surrounding areas and speak Spanish and English amongst other languages. They offer different options depending on if Resident or Non-Resident in Spain and consider special conditions enabling flexibility to the clients’ specific needs and individual situation. Banks fees vary depending on the service needed. When taking a mortgage, the bank will visit the property and draw up a valuation, to finally approve the mortgage. Mortgages can even be taken out in the clients residing country to raise funds to pay for the property in Spain outright.
Taxes
There are two types of property purchases that are made with regard to property taxes to be paid.
- If purchasing a Resale property (second hand property) there is no IVA (VAT) to be paid on the salesprice, and the client would only pay “Impuestos de Transmisiones Patrimioniales” ITP (Property Transfer Taxes).
- If purchasing a New Development (brand new property from the developer) the client pays 10% IVA (VAT) of the property price.

If to be used as an investment property we recommend sought out any additional documentation necessary to comply with Spanish rental law i.e. applying for the Touristic License (in the case of wanting to rent the property out on a short term basis), Rental insurance etc…
